1.1 This document establishes the Terms & Conditions governing the use of this Website and the purchase of products through it.
1.2 You should carefully read the Terms and Conditions before using this Website.
1.3 The Bark&Miau website, as well as all elements contained therein, are the exclusive property of Ready4Fortune Unipessoal, Lda.
1.4 By using this Website or placing an order through it, the Customer agrees to be bound by these Terms and Conditions.
1.5 If you do not agree with all the conditions, you should not use this Website.
1.6. These Terms and Conditions may be changed or adjusted at any time without prior notice, except for contracts/transactions already completed, with the changes being duly announced on this website.
1.7 It is the customer's responsibility to periodically review these Terms and Conditions in order to stay updated, as the Terms and Conditions in effect at the time of using the Website or entering into the Contract (as defined below) are the ones that will apply.

3. TARGET AUDIENCE OF THE Bark&Miau WEBSITE
The content of this website is intended for sale to individuals aged 18 and over. Bark&Miau does not guarantee that the website content is appropriate or available for use in territories other than Portugal. Individuals who choose to access this website from other countries do so on their own initiative and are responsible for complying with local laws.

4. WARRANTY
The legal regime for the sale of consumer goods, as set out in Decree-Law No. 84/2021 of October 18, applies to the sale of products by Bark & Miau.

5. LIMITATIONS OF LIABILITY
The Bark & Miau website may contain links to third-party websites or be accessed through other websites. Bark & Miau cannot be held responsible for these websites, specifically regarding their content, availability, functionality, or performance. Any decision made based on the information provided on this website is the sole responsibility of the user, and Bark & Miau assumes no liability whatsoever.

6. PERSONAL DATA COLLECTED
Bark&Miau reserves the right to share only the personal data collected that is necessary for providing the transport service, or other data necessary for completing the order and shipping process, always in accordance with the GDPR and in the customer's interest. 7. USE OF OUR WEBSITE
By using our Website and/or placing orders through it, the customer agrees to:
7.1. Use this Website only to make legally valid inquiries or requests.
7.2. Do not place any false or fraudulent orders, and if there are suspicions that such an order has been placed, we will be authorized to cancel it and report it to the competent authorities.
7.3. Please provide us with your email address, postal address and/or other contact information, truthfully and accurately.
7.4. If the Customer does not provide their email address, postal address and/or other contact information truthfully and accurately, we will not be able to process their order.
7.5. By placing an order through this website, the Customer declares that they are over 18 years of age and have the legal capacity to enter into contracts.
7.6 At any time, you can access and edit your personal data through My Account.
7.7 You may also unsubscribe from the Bark&Miau Newsletter and request the removal of all your data from the database.

8. CONTRACT EXECUTION
8.1 All information contained in these Terms and Conditions and the details included on this Website do not constitute an offer to sell, but rather an invitation to contract.
8.2 There will be no contract between us and the Customer regarding any product until the Customer's order has been expressly accepted by us.
8.3 If your offer is not accepted and a debit has already been made to your account, the full amount will be refunded.
8.4 Even after completing all the procedures outlined in the Instructions for Use, it does not mean that your order has been accepted, since it constitutes a proposal that the customer makes to us to purchase one or more products.
8.5 All orders are subject to acceptance on our part.

9. PRICE REGISTRATION AND PAYMENT METHODS
9.1 Bark&Miau undertakes to respond within 48 hours, on business days, with an email message communicating whether or not your registration request has been accepted.
9.2 When a user orders a product, they accept the prices and descriptions of the products available for sale.
9.3 Bark&Miau undertakes to honor orders received and accepted by it only up to the limit of available stock.
9.4 In the event of product unavailability, Bark&Miau undertakes to inform the user as soon as possible.

Fees and/or Taxes
All products sold at Bark & Miau are subject to the applicable Portuguese VAT (tax). For countries outside the European Community, orders may also be subject to applicable customs duties. All payments of customs duties or any other type of tax are the sole responsibility of the customer. Under no circumstances can Bark & Miau be held liable for any resulting liability.

Important Note
All payments made on the Bark&Miau website or through our payment methods will always appear on your bank statement or credit card statement with the mention “Ready4Fortune Unipessoal, Lda” or “Bark&Miau”.
Bark&Miau reserves the right to unilaterally change the price of items/products on its website/online store at any time, without prior notice.

10. NON-ACCEPTANCE / CANCELLATION OF PURCHASE
Bark&Miau reserves the right to refuse orders or cancel purchases for the following reasons, without liability for any damages or costs:
10.1 The product is no longer available, i.e., out of stock. If payment has been made for the product(s), the money will be refunded.
10.2 The billing information is not accurate or verifiable.
10.3 The order is flagged by our Security System as an incorrect order or one that may be fraudulent.
10.4 The payment transfer for the order was not received within 3 days of acceptance of your order.
10.5 When delivery to the desired address is not possible.
10.6 Bark&Miau customers have the right to freely terminate the purchase and sale contract without needing to state any reason. You can return the product within 14 consecutive days of receiving it (Article 10 of Decree-Law No. 24/2014 of February 14, with the necessary updates). Within this same period, the customer must return or deliver the product to Bark&Miau. Bark&Miau offers a collection service, which you can request through our Customer Service line. The customer is responsible for the costs of returning the order to Bark&Miau. You must use the Return Form (sent with the order); this declaration can also be made via email to hello@barkandmiau.com.

Within the specified timeframe, the product must be returned in the same condition as delivered, unused, with all components and in its original packaging. If it is not in the described conditions, Bark&Miau reserves the right to refuse its return. Always include the corresponding invoice received with your order.
In the event of contract termination, all payments made will be refunded to the customer (in cases where the order has not yet been shipped, the order delivery costs will also be refunded), without undue delay and, in any case, within 14 days from the date on which Bark&Miau is informed of the termination decision. Bark&Miau makes these refunds using the same payment method that the customer used in the initial transaction, unless expressly agreed otherwise by the customer; in any case, the customer will not incur any costs as a consequence of such a refund.

Note: In the case of payment via Multibanco or bank transfer, the refund will be made via bank transfer to the IBAN indicated by the customer.

The customer is responsible for the return shipping costs to Bark & Miau. We only refund the shipping cost if the order sent is incorrect or if the product is defective. Please do not send collect on delivery orders; these will not be accepted by Bark & Miau.
If any of the components of the product sold are missing, or if any of them are not in perfect condition, there will be no refund. You cannot cancel the purchase if you have already used the goods, except to the extent necessary to verify their nature, characteristics, and functioning, as permitted by law.
If you wish to reopen an order that was cancelled due to exceeding the payment deadline, you can contact us at hello@barkandmiau.com. It will be processed again subject to product availability.

11. SHIPPING AND AVAILABILITY OF PRODUCTS
11.1 The order will be shipped to the address provided by the user during the ordering process. For all orders, shipping costs are automatically calculated on the checkout page. The delivery time of your order always depends on confirmation of your payment.
11.3 If, at the time of delivery, the user notices any errors in the goods received, or if they are visibly damaged, they must note these circumstances on the carrier's document and inform Bark&Miau within 24 to 48 hours.
11.4 The commitment to sell the ordered product(s) is limited to existing stock and availability.
11.5 Bark&Miau, with the aim of providing a fast and quality service, is committed to shipping items as quickly as possible.
11.6 All items will remain the property of Bark&Miau until proof of payment for the total order amount is received.
11.7 The delivery time is normally as follows:
Mainland Portugal: 1-2 business days (48 hours);
Madeira & Azores: Up to 7 business days;
European Community countries: Up to 7 working days;
Countries outside the European Community: Up to 7 working days;

When placing your order, keep in mind peak order periods, such as Christmas, New Year's, or holiday periods. During these times, there is a higher probability that your order will arrive outside the timeframes described above.
Bark&Miau only ships its products on business days. This excludes weekends and holidays.
11.9 International Clients.
Order Status Check & Tracking: If you are a registered customer, simply access your account to find out the status of your order.
If you placed an order without registering on the Bark&Miau website, simply contact customer service for more information about your purchase. In these cases, always have your order number or registration email (login) on hand.

11.11 Any delay in shipping, based on the information previously mentioned, does not entitle the customer to compensation.
11.12 Bark&Miau disclaims any responsibility in case of violation of the legislation of the country where the order is delivered.
11.13 It is the customer's responsibility to check with local authorities regarding the import or usage conditions of the products they wish to order.
11.14 Bark& Miau is not responsible for damages resulting from interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent access, browsing or the provision of services to users.
11.2 Access to the Bark&Miau website is free and unrestricted, with Bark & Miau reserving the right to limit access to information and special offers only to registered users who have given their consent.
11.3 The public information present on the Bark&Miau website/online store is protected by intellectual and industrial property rights laws, and therefore copying, transmission, transfer or other use by the user is not permitted without the consent of Bark&Miau.

Use of the website barkandmiau.com
The user agrees to make appropriate use of the web content, and is obligated to:
(i) provide truthful and accurate information about the data requested in the registration or order form and keep it updated whenever you use the Web;
(ii) not to engage in illicit, illegal activities or activities contrary to good faith and public order;
(iii) not to disseminate content or propaganda of a racist, xenophobic, discriminatory nature regarding race, sex, ideology, religion or that, in any way, violates morality, public order, fundamental rights, public freedoms, honor, privacy or the image of third parties and, in general, the current regulations;
(iv) not to cause damage to the physical and logical systems of the Web, Bark&Miau's suppliers or third parties, nor to introduce or spread computer viruses or any other physical or logical systems that may be likely to cause the aforementioned damage;
(v) not to use the Web content and information therein to send advertising, send messages for any other commercial purpose, or to collect or store personal data of third parties;
(vi) not attempt to access and, if applicable, use other users' email accounts and modify or manipulate their messages.

Bark & Miau reserves the right to make any modifications it deems appropriate to its website without prior notice, and may change, delete or add both the content and services provided through it, as well as the way in which they are presented or located on its portal.

How do we use your personal data?
We may use your personal data for the following purposes:
• To create and manage your personal account on the Bark & Miau online store;
• To process your orders and returns through our online services;
• To send text message notifications regarding delivery status;
• To contact them if you encounter any problems with the delivery of your items;

Intellectual and Industrial Property
All intellectual and industrial property rights of the Website and its contents, namely images, sound, audio, video, designs, texts, graphics, logos, icons, color combinations, structure, buttons, as well as software, trade names, trademarks, works, illustrations, photographs or industrial designs and any other signs susceptible to industrial and commercial use, are the property and ownership of Bark & Miau or third parties who have duly authorized their inclusion on the Website.
The reproduction, distribution, and public dissemination, including making available, of all or part of the Web's content for commercial purposes, in any medium and by any technical means, are expressly prohibited without the authorization of Bark & Miau.
The user agrees to respect the intellectual and industrial property rights owned by Bark&Miau. The user may use the Website and its contents for their personal and private use. Any other use is prohibited and requires the user to obtain prior express written authorization from Bark&Miau.
