Exchanges

In case of exchange, you should always contact our Customer Support by sending an email. Indicate which item(s) you wish to exchange and the item(s) you wish to receive (with reference and size).

To exchange your order, you can do so through 2 options:

1 - Exchange with the courier: In the same service, the courier delivers the new order and collects the order to return. This service has a cost of €5.90 and will always be borne by the Customer. The amount must be paid in advance by Multibanco or Bank Transfer.

2 - You can also send your order by registered mail or with acknowledgement of receipt for your safety (optional) to the address of our headquarters:

After we receive your order for exchange, we will send you the new order. The shipping cost of the new order will be charged - Cost €5.90. The amount must be paid in advance by Multibanco or Bank Transfer.

Returns

a. Refund and right of free resolution

Have you decided to change your mind and wish to exercise your right to cancel? Are you not satisfied with a product? You have the option of exercising your right to cancel and returning the product(s) you no longer wish to keep within 14 days of receiving your order. You will be responsible for the return and shipping costs of the products. To obtain a refund for these products, you must return them in new condition and in their original packaging. If the products are no longer new or in their original packaging, they cannot be returned. Food or consumer products that have been opened will not be accepted for return. We ask that you carefully package the product(s) to avoid any problems during the return process.

To exercise your right of withdrawal and/or return your products, you must follow the instructions below:

  1. Log in to your Bark & ​​Miau account with your email address and password and go to the “My returns” section.
  2. Click on “Make a return request” and then select the order in question.
  3. Select the product(s) in question and then indicate the reason for the return (withdrawal or defective). To exercise your right of withdrawal, select “Withdrawal” from the drop-down menu in the “Reason for withdrawal” box. A pre-filled box is automatically added to facilitate the procedure and you will only need to validate it.
  4. You will then receive several emails indicating the steps to follow.
  5. Once your return request is accepted, you must print your “Return Guide” which you must include inside the packaging to be returned.
  6. Go to the postal services to return the package to the following address:

We strongly recommend that you keep the receipt provided by the postal service as proof of the return of your package. Bark & ​​Miau declines all responsibility in the event of loss or damage during transport of the package.

Bark & ​​Miau reserves the right to refuse any return that does not have a return guide.

Bark & ​​Miau does not accept returns of products sent cash on delivery.

You will be reimbursed for the amounts paid for the order, for the products you have returned, with the exception of the return shipping costs and initial delivery costs, which continue to be borne by you. If the Buyer returns the entire order, the initial delivery costs (the shipment of the packaging by Bark & ​​Miau to the Buyer) will be reimbursed to you. If the Buyer returns only part of the order, the initial delivery costs (the shipment of the packaging by Bark & ​​Miau to the Buyer) will not be reimbursed to you.

The refund for returned products will be made by crediting the bank card or Paypal account used when placing the order, within 14 days from the date of receipt of the returned packaging by Bark & ​​Miau.

All returns received by Bark & ​​Miau whose packaging has been returned after the 14-day period to exercise your right of withdrawal (postal service stamp to be provided), as well as all returns that do not follow the procedure set out above, cannot be subject to a refund or credit by Bark & ​​Miau.

Bark & ​​Miau reserves the right to cancel an order that is deemed not to meet the above criteria, without incurring any liability.

b. Order error

If you receive products that do not correspond to your order, you must contact us within 7 days of receiving your order, by email to geral@barkandmiau.com or by telephone on +351 915 301 711 (from 9:00 am to 6:00 pm from Monday to Friday, call without surcharge) in order to confirm the non-conformity and indicate the procedure to follow.

You will be reimbursed for the amounts paid for the products you have returned, and we will also cover the return shipping costs (you must attach proof of payment for the return shipping costs of your order, provided by the postal services). The refund for the returned products and the return shipping costs will be made by crediting the bank card or Paypal account used when placing the order, within 14 days from the date of receipt of the returned package by Bark & ​​Miau. You will also have the option of requesting a credit, which can only be used for a new order submitted on (website), and is valid for one year from the date of issue.

  1. Commercial Guarantee
a) Defective products

In accordance with article 5 of DL no. 84/2021, of October 18, Bark & ​​Miau is obliged to deliver goods in accordance with the order placed by the Buyer and must be liable for any defects in conformity existing at the time of delivery of said goods. In this regard, in order to be in accordance with the contract, the goods must:

a) Be suitable for the use normally expected of a similar good and, if applicable:

correspond to the description given by Bark & ​​Miau and possess the qualities that it presented to the Buyer, if applicable, in the form of a sample or model;

present the qualities that a Buyer can legitimately expect from the public statements made by Bark & ​​Miau, the manufacturer or its representative, in particular in advertising or on labels;

b) Or present the characteristics defined by mutual agreement of the parties or be suitable for any special use investigated by the Buyer, brought to the attention of Bark & ​​Miau and which it has accepted.

Likewise, according to Decree-Law No. 84/2021, of October 18, Bark & ​​Miau is obliged to provide a guarantee for hidden defects in the item sold that make it unfit for the use for which it was intended, or that reduce this use to such an extent that the Buyer would not have acquired it, or would only have acquired it at a low price if he had been aware of these hidden defects.

If the products delivered do not conform to the products ordered by the Buyer or if they present hidden defects, the latter must contact Customer Service by telephone on 915301711 (weekdays, from 10:00 to 18:00) or via the contact form, to notify them of the non-conformity or hidden defects of their product(s) as soon as possible.

Customer Service acknowledges receipt of the Buyer's request and informs the Buyer of the next steps. After receiving instructions from Customer Service, the Buyer returns the non-compliant products or products with hidden defects to the Seller to the following address:

On the other hand, it should be remembered that, under the legal guarantee, in accordance with article 12 of Decree-Law no. 84/2021, of October 18, the Buyer benefits from a period of three years from the delivery of the goods to act.

The product(s) must be (i) returned complete, partially used, in their original packaging intact and (ii) accompanied by their original packaging, as well as the return slip sent by Customer Service and the invoice. Furthermore, Epiik does not accept packaging sent cash on delivery. All risks associated with the return of the product(s) are borne by the Buyer. Upon receipt of the product(s) presumed to be non-compliant or to have hidden defects, Bark & ​​Miau will carry out an inspection of the product(s) to verify whether or not said product(s) is in conformity.

If the non-conformity of the product(s) is confirmed, the consumer has the right:

a) Restoration of conformity, through repair or replacement of the asset;
b) A proportional reduction in the price; or
c) Termination of the contract.

2 - The consumer may choose between repair or replacement of the good, unless the means chosen to restore conformity is impossible or, in comparison with the other means, imposes disproportionate costs on the professional, taking into account all circumstances, including:

a) The value that the goods would have if the lack of conformity had not been found;
b) The relevance of the lack of conformity; and
c) The possibility of resorting to an alternative means of restoring conformity without significant inconvenience to the consumer.

3 - The professional may refuse to restore the conformity of the goods if repair or replacement is impossible or imposes costs that are disproportionate, taking into account all the circumstances, including those mentioned in subparagraphs a) and b) of the previous number.

4 - The consumer may choose between a proportional price reduction, under the terms of article 19, and termination of the contract, under the terms of article 20, if:

a) The professional:
i) Has not carried out the repair or replacement of the good;
ii) Has not carried out the repair or replacement of the asset in accordance with the provisions of article 18;

iii) Has refused to restore the conformity of the goods under the terms of the previous number; or
iv) Has declared, or it is clear from the circumstances, that it will not restore the goods to conformity within a reasonable period or without serious inconvenience to the consumer;

b) The lack of conformity has reappeared despite the professional's attempt to bring the goods into conformity;
c) A new lack of conformity occurs; or
d) The seriousness of the lack of conformity justifies the immediate reduction of the price or the termination of the purchase and sale contract.

5 - The price reduction must be proportional to the decrease in the value of the goods that were received by the consumer, compared to the value they would have if they were in conformity.

6 - The consumer does not have the right to terminate the contract if the professional proves that the lack of conformity is minimal.

7 - The consumer has the right to refuse payment of any remaining part of the price to the professional until the latter complies with the duties provided for in this decree-law.

8 - The provisions of the previous number do not grant the consumer the right to refuse payments that are in arrears.

9 - The right to terminate the contract or to a proportional reduction in the price may be exercised when the lack of conformity has led to the loss or deterioration of the goods for reasons not attributable to the consumer.

10 - The rights provided for in this article are transferred to the third party acquiring the property free of charge or for a fee.

In cases where the lack of conformity becomes apparent within 30 days after delivery of the goods, the consumer may request the immediate replacement of the goods or the termination of the contract.
